Can posting about my car accident on social media affect my personal injury case?

On Behalf of | Jan 19, 2023 | Personal Injury

Posting about a car accident on social media can potentially affect a personal injury case.

Here are some ways that social media posts can influence your case and why it is important to be cautious when sharing information online.

Evidence in court

Anything posted on social media often becomes evidence in court. This includes pictures, videos and statements about the accident and your injuries. If your post contradicts the information provided in your personal injury case, it can potentially damage your credibility and weaken your claim. For example, Forbes reported on the 2018 case Largent v Reed in which a plaintiff claimed physical and mental pain from a car accident, but her social media showed her going to the gym and conducting life as usual.

Statements to insurance companies

Insurers will use statements made on social media to minimize the value of your claim. Like the example above, if you post pictures of yourself participating in activities that you claim to be unable to do because of your injuries, the defendant will argue that your injuries are not as severe as you claim.

Privacy

Posting about a car accident on social media can also compromise your privacy. Once information is posted online, hundreds or thousands of others can share it almost instantaneously, potentially reaching people you did not intend to share it with. This can include the opposing party in your personal injury case, who may use the information against you. Always be wary of what you post if you think the situation may end up in a court of law.
